    The essentials in one minute

    Posting a listing on Dénichéo is free. These terms of sale therefore only cover the optional services you buy directly from Dénichéo to give your listings more visibility: promotions, availability countdown, cross-posting, extra photographs and periodic bumps. They never apply to transactions between members: when you sell or buy an item from another member, Dénichéo is not a party to the contract and receives no commission. These terms address consumer Members; professional Members are covered by the professional terms of service.

    • These terms only cover paid options sold by Dénichéo, never what you buy from another member.
    • Prices are firm, in euros, inclusive of all taxes. Nothing is charged without an explicit order from you.
    • No consumer option renews automatically: each purchase is a one-off.
    • You have 14 days to withdraw, unless you requested immediate performance and expressly waived that right — which is the case for a promotion activated straight away.
    • An invoice is issued for every purchase and stays available in your “Mes factures” area.

    Article 1

    Purpose and scope

    In plain wordsThis document only governs what you buy from Dénichéo as a consumer.

    These terms of sale govern the sale, by WB CONSULTING (William BASTARD, sole trader), of the optional digital services offered on the Dénichéo platform to members acting as consumers.

    They do not govern sale, gift or swap contracts concluded directly between members: Dénichéo is not a party to them, receives no commission and takes no part in payment or handover.

    Services intended for professional members — professional plans, local advertising, catalogue import, technical access, website links — are governed exclusively by the professional terms of service.

    Ordering any paid service entails unreserved acceptance of these terms in the version in force on the date of the order, as well as of the terms of use.

    Services offered and essential characteristics

    In plain wordsHere is exactly what each option does, and for how long.

    The paid services available to a personal account are digital services that improve the visibility of a listing. They do not alter the listing's content or the seller's obligations, and guarantee no commercial outcome.

    Their essential characteristics and current prices are shown on the “Tarifs” page of the Platform and on the order screen before validation.

    • “Vedette” promotion — €3.00: the listing appears in featured placements for 3 hours.
    • “Urgent” promotion — €3.00: an “Urgent” label is added, reinforcing the listing's perceived priority.
    • Availability countdown — €5.00: a countdown is displayed before the announced availability expires (24 hours by default, up to 72 hours).
    • Cross-posting to TikTok — €5.00: the listing is published on Dénichéo's TikTok account, after the member validates the content on a review screen.
    • Extra photograph — €0.20 per photograph beyond the 3 included per listing, with a minimum payment amount of €0.50.
    • Weekly bump to the top of the list for 1 month — €4.99: one bump per week.
    • Daily bump to the top of the list for 7 days — €7.99: one bump per day.
    • Daily bump to the top of the list for 14 days — €12.99: one bump per day.
    Good to knowWhere this list differs from the “Tarifs” page, the characteristics and prices shown on the order screen at the time of validation prevail. As featured placements are limited in number, the visibility obtained depends on how many listings are promoted at the same time in the same area.
    Article 3

    Prices and taxes

    In plain wordsThe price displayed is the price paid. No VAT is charged today.

    Prices are stated in euros, inclusive of all taxes, excluding connection and electronic communication costs, which remain payable by the member.

    The publisher currently benefits from the French VAT exemption scheme for small businesses (Article 293 B of the French General Tax Code): VAT does not apply and the amounts invoiced are net of tax. Invoices bear the corresponding statutory wording.

    The applicable price is the one displayed on the order screen at the time of validation. Dénichéo may change its prices at any time for the future; such changes do not affect orders already validated.

    The minimum payment amount applicable to extra photographs is shown before the order is validated.

    Good to knowThis clause will be updated as soon as the publisher becomes liable for VAT: prices will then be displayed showing the amount excluding tax, the applicable rate and the amount including tax.
    Article 4

    Orders and formation of the contract

    In plain wordsThe contract is only concluded after a summary screen and an explicit click on a button stating the obligation to pay.

    Orders are placed exclusively online, from a member account, in three steps: selecting the service or services, displaying a detailed summary allowing the order to be checked and corrected, then validating it.

    In accordance with French law, the validation button bears unambiguous wording indicating that placing the order entails an obligation to pay.

    The sale is complete once the order is validated and the payment accepted by the payment service provider. A confirmation summarising the order is sent to the member on a durable medium, by email.

    Dénichéo reserves the right to refuse or cancel an order from a suspended account, an account with a previous unpaid balance, or where fraud or misuse of the Service is seriously suspected. The member is informed and, where applicable, refunded.

    Article 5

    Payment terms

    In plain wordsCard payment via Stripe. Dénichéo never sees or stores your card number.

    Payment is made in full at the time of the order, by bank card, through the payment service provider Stripe Payments Europe Ltd.

    Card details are entered in a secure environment operated by the payment provider and neither pass through nor are stored by Dénichéo, which only accesses the data strictly needed to track the order (status, amount, partial payment method fingerprint).

    Strong customer authentication may be required by the card issuer, in accordance with Directive (EU) 2015/2366 on payment services.

    The member may apply all or part of the price against their virtual credit, within the limits set by Dénichéo. Any remaining balance is paid by card. Virtual credit is neither refundable nor convertible into cash.

    If authorisation is refused, rejected or the payment fails, the order is cancelled automatically and the corresponding service is not supplied or is interrupted.

    Article 6

    Performance of the service

    In plain wordsOptions are activated immediately after payment and last exactly as long as announced.

    Unless otherwise stated before the order, services are performed immediately after payment is confirmed, and no later than within twenty-four (24) hours.

    The duration of each service is the one stated in its essential characteristics. It runs from actual activation and is neither suspended nor extended by any action of the member on their listing.

    Cross-posting to a third-party social network depends on the availability and rules of that platform. If publication is refused by that third party for reasons beyond the member's control, the service is deemed not performed and is refunded or reactivated at no extra cost.

    Deleting, deactivating or moderating a listing at the member's initiative while a service is running ends that service without any right to a refund. Conversely, where the withdrawal results from a Dénichéo moderation decision subsequently found to be unfounded, the service is reactivated or refunded pro rata to the unperformed period.

    Article 7

    Right of withdrawal

    In plain words14 days to change your mind — unless you asked for immediate activation, which waives that right once the service is performed.

    Under French consumer law, a consumer member has fourteen (14) days from conclusion of the contract to exercise their right of withdrawal, without giving reasons and without bearing costs other than those provided by law.

    However, that right cannot be exercised for a service contract fully performed before the end of the withdrawal period, where performance began with the consumer's prior express consent and express acknowledgement that they would lose their right of withdrawal. Nor can it be exercised for the supply of digital content not supplied on a tangible medium where performance began after the consumer's prior express consent and express waiver of that right.

    As the services offered by Dénichéo are by nature performed immediately, the member is asked, on the order screen, expressly to request immediate performance and to acknowledge that they will lose their right of withdrawal once the service is fully performed. That request and acknowledgement are collected separately from acceptance of these terms and confirmed on a durable medium.

    Where immediate performance was not requested, or where performance has not yet begun, the member may withdraw by notifying an unambiguous statement before the end of the fourteen-day period, using the model form below or any other written statement.

    Where performance began at the member's request but is not complete on the date of withdrawal, the member pays an amount proportionate to what has been supplied up to the time they communicated their decision.

    Reimbursement is made within a maximum of fourteen (14) days of receiving the withdrawal decision, using the same means of payment as the original transaction unless the member expressly agrees otherwise. Any virtual credit used is credited back to the account.

    • Model withdrawal form — to be completed and returned only if you wish to withdraw: “To WB CONSULTING, 11 rue Georges Gay, 93130 Noisy-le-Sec, France, [email protected]. I hereby give notice of my withdrawal from the contract for the supply of the following service: [name of the option or service]. Ordered on [order date]. Consumer's name: [name]. Consumer's address: [address]. Signature (only if this form is notified on paper). Date: [date].”
    • The statement may be sent from the “Support” area of the account, which timestamps the request, or by email to the publisher's contact address.
    Worth notingA promotion activated immediately at your request is fully performed as soon as its display period ends: after that point, the right of withdrawal can no longer be exercised for that service.
    Article 8

    Invoicing

    In plain wordsEvery purchase generates an invoice, stored in your account and downloadable as a PDF.

    An invoice is issued for every paid order and made available to the member in the “Mes factures” section of their account area, in a downloadable and storable format.

    The invoice contains the mandatory particulars required by French commercial and tax law, in particular identification of the seller and buyer, issue date, sequential number, description of the services, unit price and applicable tax regime.

    Any correction gives rise to a credit note cancelling or amending the original invoice and expressly referring to it.

    Invoices are retained and remain accessible to the member throughout the life of their account, and thereafter for the statutory retention period for accounting records.

    Article 9

    Legal warranty of conformity for digital services

    In plain wordsIf the option you bought does not work as announced, you may require it to be brought into conformity, then a price reduction or a refund.

    Dénichéo must supply digital services that conform to the contract and is liable for any lack of conformity existing at the time of supply, under French consumer law.

    For a one-off supply, that warranty covers lacks of conformity appearing within two (2) years of supply. For continuous supply, it applies throughout the supply period.

    In the event of a lack of conformity, the member may require the service to be brought into conformity free of charge and within a reasonable time. Where that is impossible, unduly delayed or causes major inconvenience, the member may obtain a price reduction or termination of the contract and reimbursement of the sums paid.

    The legal warranty applies independently of any commercial warranty and free of charge for the member. Defects resulting solely from the member's digital environment, where they were duly informed, fall outside its scope.

    Any claim under this warranty is made through Dénichéo's support desk, which acknowledges receipt and handles the claim.

    Article 10

    Customer service and complaints

    In plain wordsA support area tracks each request, with a ticket reference and full history.

    Any question, complaint or request relating to an order may be sent to Dénichéo's support desk, from the account area or the public support page, or to the publisher's contact email address.

    Each request is given a tracking reference and a viewable history. Dénichéo undertakes to acknowledge receipt within a reasonable time and to provide a reasoned reply.

    Complaints about a moderation decision follow the internal redress procedure described in the terms of use.

    Article 11

    Liability and force majeure

    In plain wordsWe answer for performing the service sold, not for the commercial success of your listing.

    Dénichéo is automatically liable to consumer members for the proper performance of obligations arising from the distance contract. It may be released by proving that the failure is attributable to the consumer, to an unforeseeable and insurmountable act of a third party unconnected with the contract, or to force majeure.

    The services sold are visibility services: they carry no obligation of result as to the number of views, contacts received, or the actual conclusion of a sale.

    Neither party may be held liable for a failure resulting from force majeure. Where the impediment is permanent, the contract is terminated automatically and sums corresponding to the unperformed part are refunded.

    Article 12

    Personal data

    In plain wordsOrder data is retained for accounting and evidential purposes, within statutory periods.

    Data collected in connection with an order is processed to perform the contract, issue invoices, comply with accounting and tax obligations, prevent fraud and handle complaints.

    Retention periods, recipients and how to exercise your rights are detailed in the privacy and cookie policy.

    Payment data is processed by the payment service provider, acting as controller as regards transaction security and fraud prevention.

    Article 13

    Consumer mediation

    In plain wordsAfter a written complaint that has not been resolved, you may refer the matter free of charge to a mediator.

    Under French consumer law, a consumer member may refer the matter free of charge to a consumer mediator with a view to the amicable resolution of a dispute with Dénichéo.

    A referral to the mediator is admissible only after a prior attempt at direct resolution through a written complaint to the support desk, and within one year of that complaint.

    Mediation is voluntary: each party remains free to use it, to withdraw from it and to bring the matter before the competent court.

    Good to knowDénichéo's membership of a consumer mediation scheme is being finalised. The mediator's full details (name, postal address, referral website) will be published on this page as soon as that membership is confirmed. In the meantime, all complaints are handled directly by the support desk, without depriving consumers of their right to bring proceedings before the competent court.
    Article 14

    Governing law and jurisdiction

    In plain wordsFrench law, and consumers may always bring proceedings where they live.

    These terms are governed by French law, without prejudice to more protective mandatory provisions of the consumer's country of habitual residence.

    In the event of a dispute, a consumer member may bring proceedings, at their choice, before the court of the place where they resided when the contract was concluded or where the harmful event occurred, or before the court of the defendant's domicile.

    These terms are drafted in French; in the event of discrepancy with a translation, the French version prevails.
